AVENU INSIGHTS & ANALYTICS PRIVACY POLICY

This Privacy Policy (“Policy”) outlines how Avenu Insights & Analytics, LLC and all subsidiaries, parent entities, divisions, departments, and affiliates of Avenu Insights & Analytics (“Avenu”, “we”, “us”, “our”) collects, uses, discloses, and protects personal identifiable information obtained in the course of providing software products and services to state and local governments across the United States. This Policy applies to individuals who interact both online and offline with Avenu’s software products, services, websites, and related applications (collectively referred to as “Services”).

Changes to This Policy

We reserve the right to change this Policy. When we do, we will also revise the “Effective Date” at the top of this Policy. If we make material changes to the Policy, we will notify you by placing a prominent notice on our website and/or by sending you an email at the email address we have on file for you. We encourage you to periodically review this Policy to keep up to date on how we are handling your personal identifiable information.

Important Information and Who We Are

Avenu provides administrative and revenue enhancement software products and services (“Services”) to state, local and federal jurisdictions (“Avenu Customers”).  Our Services include compliance auditing; short term rental, permitting, license and tax solutions; unclaimed property solutions; digital transformation; finance, human resources, and property tax solutions; justice solutions; management services; payment solutions; pension administration; and records solutions.

Personal Identifiable Information Collected

Avenu may collect, process, store and transfer the following categories of personal identifiable information:

  • Information collected as a website visitor or as a participant in marketing opportunities or purchasing Services: When you access our websites, participate in marketing or promotional opportunities, or purchase our Services, we may collect certain personal identifiable information automatically, such as your name; email; phone number; address; IP address; search parameters; page URL; timestamp; and other related information. We use this information for marketing, analytics, security, and to improve our Services.
  • Information collected in providing Services to Avenu Customers: When Avenu provides Services to Avenu Customers, we may collect personal identifiable information such as your name; address; property description; email address; IP address; phone number; social security number; date of birth; personal health information; individual and business tax information; income and occupational data; financial data; credit card, banking and financial account information; driver’s license identifier; and other related information. This information is necessary for the administrative and revenue enhancement Services that Avenu provides to our Customers.
  • Information collect throughout the employment and hiring process: When you participate in the employment and/or hiring process at Avenu, we may also collect personal identifiable information such as your name; email; phone number; address; current or past employers; credit history; employment eligibility; personal health information; educational information; and other related information.  We use this information for purpose pertaining to your employment relationship with Avenu.

How We Use Personal Identifiable Information

Avenu will only use personal identifiable information as allowed by law.  Most commonly, Avenu uses personal identifiable information for the following purposes:

  • Service Delivery:  Avenu has a legal basis and legitimate interest in using personal identifiable information where necessary or appropriate to provide Services to Avenu Customers.
  • Legal Compliance: Avenu processes personal identifiable information as required by applicable legal, regulatory, and contractual obligations.
  • Communication: We may use personal identifiable information to send marketing communications, respond to your requests and inquiries, and provide Customer support.
  • Improvement: We may use personal identifiable information to analyze usage patterns, conduct research, and improve user experiences.
  • Recruitment and Employment: We may use personal identifiable information to recruit and assess employment applications and, if established, execute employment relationship.

Disclosure of Personal Identifiable Information

Avenu may share personal identifiable information in the following circumstances and for the following reasons:

  • Avenu Customers: Avenu may disclose personal identifiable information to our Customers as necessary to provide our Services.
  • Service Providers: Avenu may engage trusted third-party service providers, agents, or independent contractors (“Providers”) who assist us in delivering our Services. These Providers are obligated to maintain the confidentiality and security of personal identifiable information. Avenu does not allow our Providers to use your personal data for their own purposes and only permits Providers to process your personal data for specified purposes and in accordance with our instructions.
  • Legal Obligations: We may disclose personal identifiable information to law enforcement, government agencies, and other related third parties to comply with the legal, regulatory, contractual obligations and/or governmental request; enforce Avenu policies; or protect Avenu or others’ rights, property, or safety.
  • Reorganization Process:  Avenu may share personal identifiable information in the course of any reorganization process including, but not limited to, mergers, acquisitions, and sales of all or substantially all of our assets.

Data Security

Avenu has implemented appropriate security measures to protect your personal identifiable information from unauthorized access, use or disclosure.  However, no method of transmission of data over the internet or electronic storage can be guaranteed to be entirely secure.  Consequently, Avenu cannot ensure or warrant the security of any personal identifiable information you transmit to us and you understand that any information that you transfer to us is done at your own risk.

In addition, Avenu limits access to your personal data to those employees, agents, contractors, and other third parties who have a business need to know. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality.

Data Retention

Avenu will only retain your personal identifiable information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

Your Privacy Rights

Under certain circumstance, and depending on your jurisdiction and applicable laws, you may have the right to require Avenu to:

  • You have the right to request access to or a copy of your personal identifiable information held by Avenu.
  • You have the right to send corrections to your personal identifiable information held by Avenu.
  • You may request the deletion or transfer of your personal identifiable information, subject to legal obligations and contractual requirements.
  • You may object to or request restriction of the processing of your personal identifiable information, subject to legal obligations and contractual requirements.
  • You can opt-out of or withdraw consent to receiving promotional communications from us by following the instructions provided in such communications.
  • You may request further information regarding how Avenu uses your personal identifiable information, subject to legal obligations and contractual requirements.

Avenu is obliged to keep your personal information accurate and up to date. Please help us to do this by advising us of any changes to your personal information.

Under certain circumstances, Avenu may need to restrict your privacy rights to safeguard the public interest, e.g., the prevention or detection of crime, and our interests, e.g., the maintenance of legal privilege.

Your Right to Complain

If you are not satisfied with our use of your personal information or our response to any request by you to exercise your rights, or if you think that we have breached any relevant data protection laws, then you have the right to complain to the data protection authority that supervises our processing.

California Privacy Rights

Under the California Consumer Privacy Act, residents of California are provided with certain rights regarding their personal information:

  • The right to know, by way of our Policy and any specific inquiries you direct to us, the categories of personal information Avenu collects from you, the source(s) of that personal information, what Avenu uses that information for, whether it is being disclosed or sold, and if so, to whom.
  • The right to “opt-out” of Avenu’s sale of your Personal Information to any third parties.
  • The right to request Avenu to stop sharing your Personal Information with third parties.
  • The right, with some exceptions, to have your Personal Information deleted from
  • Avenu’s possession or control.
  • The right to correct inaccuracies in your Personal Information.
  • The right to receive equal service and pricing from Avenu even if you exercise any of your privacy rights.

For all California residents, any such inquiries shall be responded to within forty-five (45) days and at no cost to you. We must verify your identity with respect to such inquiries. Depending on the nature of the Personal Information at issue, we may require additional measures or information from you as part of that verification.

California Civil Code Section 1798.83 permits California residents who use our website to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.

We do not and will not sell personal information about California residents, as defined under California state law. We also have not done so for the last 12 months.

For California residents under age 18 who have publicly posted content or information, you may request and obtain removal of such content or information pursuant to California Business and Professions Code Section 22581, provided you are registered user of any website where this Policy is posted. Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that the law may not require or allow removal in all instances, even if requested.

Collection & Use of Information from Children

Our Services are not intended for children. We do not knowingly collect personal information from children, and none of our Services are designed to attract children. In the event that we learn that a person under the age of 13 has provided personal information to us, we will delete such personal information as soon as possible.

Cookies

This site employs cookies and web beacons to track usage and provide a better online experience. Some portions of the site may not be available if the user’s browser will not accept cookies. Some of this collected information is retained and other data is discarded as Avenu modifies this site. Visitors may choose to register and accept periodic transmissions from Avenu. Avenu does not sell e-mail addresses collected through this site. Identifying information submitted through the site may, however, be shared with our partners for the purpose of providing additional information to users.

How We Respond to Do-Not-Track Signals

At this time, Avenu’s website does not recognize automated browser signals regarding tracking mechanisms, which may include “Do Not Track” instructions.

Consent and Opting Out of Marketing Communications

Avenu does not generally process your personal information based on your consent (as we can usually rely on another legal basis). Where Avenu does process your personal information based on your consent, you have the right to withdraw your consent at any time. Avenu provides you the opportunity to opt-out of marketing communications by clicking the “unsubscribe” link in email communications or by contacting us using the contact information provided below. Avenu will process your request as soon as possible in accordance with applicable law, but please be aware that in some circumstances you may receive a few more messages until the unsubscribe is processed.

Avenu may send you information regarding our Services such as information about changes to our policies and other notices and disclosures required by law. Generally, users cannot opt-out of these communications, but they will be primarily informational in nature, rather than promotional.

International or Cross Border Transfers

Avenu may transfer and process personal identifiable information across national boundaries.  When doing so, Avenu will ensure appropriate safeguards are in place in compliance with relevant data protection laws to protect your personal identifiable information.

Updates to this Policy

Avenu may update this Policy from time to time to reflect changes in our practices or legal requirements. We will notify you of any material changes through our website or other means.
